Supply Chain Management – Greening Beyond Reverse Logistics.

In a world which is experiencing climate crisis in the form of increased ecological footprint because of environmental damage caused by various businesses, there is an immediate need for value seeking and proactive approach based on increasing the efficiency of reverse logistics aspect of modern supply chains. This paper looks at steeps to lower the ecological footprint of the supply chains, challenges involved in adopting green steps and the practical problems encountered in the making of green supply chains. Key words:Supply chain management, ecological footprint, environmental management strategies, green issues Introduction: Supply chain management is the coordination and management of a complex network of activities involved in delivering a finished product to the end user or customer . it is a vital business function and the process includes sourcing raw materials and parts, manufacturing and assembling products, storage, order entry and tracking, distribution through the vario us channels and finally delivery to the customer.A company’s supply chain structure consists of external supplier’s ,internal functions of the company and external distributors as well as customers (commercial or end-user). firms may be members of multiple supply chains simultaneously . the management and corporation is further complicated by global players spread across geographic boundaries and multiple time zones . the successful management of a supply chain is also influenced by customer expectations, globalization, information technology, government regulation, competition and the environment.Management of the supply chain is taking an important role in lowering environmental impact of business in this aspect the principle of ecological footprint shows how relevant are the green initiatives in maintaining ecological balance. It is aurgived that companies should assess the impact of their economic on the environment and resource consumption, the footprint is define d as the amount of land required to meet a typical consumer’s needs for many countries the ecological footprints exceed the actual area of the respective countries, for example the ecological ootprint of the Netherlands is 15 times the area of the countryEnvironmental management is gaining increasing interest among researchers in supply chain management, the concept of greening is becoming a critical avenue of this area, also the organizations are assigning increasing importance to the environmental issues. Despite some early steps a well knit theory or framework for greening of supply chains is lacking. Research initiatives are needed to overcome this problem, especially the research may have to move beyond reverse logistics, into the development of green supply chains.It is proposed that reverse logistics alone may not be enough and that a focus on the entire supply chain is more relevant for understanding the impact of business practices on the environment . this approach gels with value seeking approach of the environment that leverages the potential contribution of greening to the business organizations. The focus of greening as a competitive initiative by the business organizations represents a more proactive approach of greening instead of reacting to compliance measures of environmental regulations of several governments. The concept of reverse logistics:Reverse logistics stands for operations related to the reuse of products and materials which are part of the supply chain, it is the process of planning, implementing and controlling the efficient, cost effective flow of raw materials, in-process inventory ,finished goods and related information from the point of consumption to the point of origin for the purpose of recapturing value or for attaining proper disposal, simply reverse logistics is the process of moving goods from their typical final destination for the purpose of capturing value or proper disposal, the reverse logistics process inc ludes the management and the sales of sapless as well as returned equipment .Normally logistics deals with events that bring the product towards the customer. In the case of reverse logistics atleast one step back in the supply chain. For example, goods move from the customer to the distributer or to the manufacturer. As reverse logistics is gaining increasing interest and relevance, the question becomes whether it is enough to limit greening efforts to one segment of the supply chain and to single company. Following is a diagram given below which gives a commonly used scheme for implementing environment friendly initiatives in a company.Thisscheme depicts that there is much more to greening than the reversed flow of goods only. reening can start rite at the source with supply conditions and can work its way through storage and packaging practices to distribution and to end-consumers all of which is referred to as green supply chain management (GSCM). green supply chain management i s adding the â€Å"green component† to the supply chain and it involves addressing the influence and relationships of supply chain management through the natural environment. Green supply chain management (GSCM) =green purchasing+ green manufacturing/materials management+ green distribution/marketing+ reverse logistics This reverse flow in reverse logistics can take different forms,from collection to return shipments into the distribution channel followed by disassembly and reuse of selected parts. Alternatively, goods could be scrapped and re-entered into production as raw materials.Return goods or elements of the product, could even be returned to suppliers and supply chain partners for them to re-manufacture. Other possible supply chain applications should be taken into consideration. for example, disassemblies operations in the reverse flow can be replaced by incorporating a proactive â€Å"design for disassembly â€Å" right in the initial product design stage of both supplier and customer. What are the approaches for going green. The implementation of greening as a competitive initiative was explained in detail by porter and van der linde(1995) they reasoned that investments in greening can be recourse saving, waste eliminating and productivity improving.As a result, green initiatives can lower not only the environmental impact of a business, but also rise efficiency, possibly creating major competitive advantages in innovation and operations. Kopicki et al. (1993),introduced three approaches in environmental management: the reactive, pro-active and value-seeking approach. in the reactive approach companies commit minimal resources to environmental management as they start to procure some products with some recycled content, start labeling products that are recyclable. in the proactive approach, companies start to implement new environmental laws by realizing a modest recourse commitment to initiate the recycling of product and designing green p roducts.In this approach the ompany assumes responsibility over product re-use and recycling as an element of environmental management. The most far reaching approach is value-seeking, in that companies integrate environmental activities into a business strategies and operate the firm to reduce its impact on the environment as a strategic initiative. The head of the organization establishes a strong environmental commitment and the capital commitment is shared among partners in the supply chain. Operating systems in the value-seeking face may include the re-design of the products for dis-assembly, the use of life cycle analysis of the product and creating and involment of third parties.Companies are integrating environmental management into corporate strategic planning and into day-to-day process as they adopt a recourse-productivity frame work to maximize benefits attained from environmental programs. Theextention of kopicki et al. (1993) framework offered by Walton et al. (1998) i s that they state that companies will only thrive in the final face of environmental management when they act as a whole system that includes customers, suppliers and other players in the supply chain. By developing a supply chain approach in the environmental management process, the impact on supply chain operation gets leveraged throughout the supply chain.They detail how such an approach requires cross functional and cross company activities including product design, suppliers, processes, evaluation systems and inbound logistics. Walley and whitehead (1994) mentioned the value-based approach as the most far-reaching approach in environmental management. They characterized this approach as systematic, through the strong commitment and integration of flexible strategies and structures, throughout the supply chain. Within this approach three types of activities are undertaken: operational, technical and strategicactivities, depending on the impact on value and the scope of discretio nary response. What are the green steps to be taken: If a supply chain approach is so important in a value-seeking greening initiative how should businesses develop such an approach?The first step to be taken in greening the supply chains involve identifying the various supply chain flows and customizing the greening approaches basing on a particular supply chain flow. There are five supply chain flows- materials, services, financial, information and knowledge, and wasteflows. These flows may also have different scale levels, and thus, are directly related tothe boundaries that envelop them or through which they flow. The types of flows, theirpurpose, and how they are managed may also differ depending on the boundary context. For example, materials flows from an organizational boundaries perspective wouldrequire that materials be cooperatively agreed upon by managers and designers, and froma proximal perspective the decisions on where they are designated to be located andstored.Anot her example would be information flows where legal requirements have themmanaging the information so they can be reported to customers, while information relatedto environmental costs may only be of concern to an operations manager orenvironmental department. We now provide an overview of the different flows and somerelationships and studies on green supply chain. Materials Flows Materials flows are typical physical flows associated with supply chains and mayinclude parts, components, raw materials or finished goods. Much of the research insupply chain management has focused on the management of tangible durable goods. One of the basic tools is material flow analysis which has been recommended forevaluating an integrated environmental supply chain.The environmental aspects ofthese flows are well documented in and between organizations and have implications onall forms of environmental media implications ranging from solid waste management, Resource productivity, dematerialization an d climate change issues. Some recentresearch has proposed that material flow analysis be a core aspect of managing supplierenvironmental relationships. Service Flows These flows represent more intangible flows of services amongst organizations. Example service flows would be utilities and transportation services offered toorganizations. Some of the service flows from these two industries are major contributorsto the major environmental concerns facing the world, climate change, and are criticalelements of the supply chain.Since we incorporate utilities into this flow, we couldinclude energy service and critical water flows, albeit water may also be a physicalMaterial flow. Energy services in the supply chain are essentially pertinent since they aregrouped at levels of importance similar to material flows and are also critical flows for service industries. In fact, the energy service providers have greatly increased inimportance amongst supply chains as deregulation (especially in th e US) has seenincreased growth since the early 1990’s. Services may include many supportingactivities that may not be completely carried out by the organization or require specificmaterials. Information and financial services may also fall within this scope for industrial and retail level consumption.This more generic service industry has seen little researchin the green supply chain management literature, except for some hospitality and tourismservice industry perspectives . Within the supply chain, the shift to dematerialization could be enhanced with servicizing materials flows . Servicizing, also defined as product-service systems, is essentially the process of selling services rather products or materials toorganizations. One example of this is in Xerox’s strategy to offer a service, documentmanagement, for its copiers by leasing them rather than selling them. It provided aleasing service of a product which was taken back and reclaimed after lease expiration.Ina s ervicizing relationship, both the buyer and the supplier wish to decrease materialusage, where cost savings can be shared. Another aspect of service flows are those services provided by nature and includethe following ecosystem service categories: provisioning such as the productionof food and water; regulating, such as the control of climate and disease; supporting, suchas nutrient cycles and crop pollination; cultural, such as spiritual and recreationalbenefits; and preserving, which includes guarding against uncertainty through themaintenance of diversity. Managing these service flows may or may not be under thecontrol of a man-made supply chain, but certainly have some relationships to all supplychains. Financial FlowsFinancial flows are primarily the flow of capital (money) across the supply chain. These flows are critical to the management of supply chain practices. The environmentalimplications of these flows are mostly associated with the funding of practices andservice/mate rial flows which may cause environmental damage and consumption. The management of these flows can have profound environmental implications (forexample financial institutions may not lend due to environmental risks associated withcertain organizational projects). Tools integrating the financial flows into supply chainmanagement have relied on standard accounting tools such as activity based costing.Financial flow evaluation and analysis integrated into environmental supply chainmanagement has been very limited. As the recent world financial crisis shows, financialsystems will greatly regulate the amount of material flows and requirements for allsupply chains. One of the missing links in evaluating financial (capital) flows is the integrationof nature’s capital into the evaluation of supply chain economics. Integration ofnature’s services into supply chains’ financial flows analyses can provide significantlymore accurate perspectives on the influence of environme ntal supply chain managementpractices of organizations. The difficulty arises from the various assumptions that have tobe made for such a flow.Valuation of environmental resources is certainly a mystifyingexercise with significant variances in estimations. Information Flows Information and knowledge flows are also one of the critical management aspectsof green supply chain management. Much of the environmental information withinthe supply chain can be related to product life cycles and LCA type analyses . Operations across the supply chain can also benefit the environment just with regularinformation. Some of these benefits can be tied to the principle of informationsubstitution, having accurate information about material and goods that replace the needto hold durable material and goods.Information substitution can greatly reduce theamount of energy, transportation, and material inventory in the supply chain. Withthe advent of e-commerce and inter-organizational information systems within the supplychain, information substitution along the supply chain will have significantenvironmentally beneficial influence. Knowledge flows arise from having knowledge of environmental policies,technology, practices, and programs that can be shared across the supply chain. Not onlyare operations effected by knowledge, but supply chain innovation is also influenced. Innovation builds on and requires knowledge, knowledge generation, and knowledgeexchange.Innovation from knowledge flows are especially pertinent to smallerorganizations within the supply chains who typically lack the knowledge resourcesrelated to environmental actions for their operations. Environmentally orientedorganizational and inter-organizational learning is also dependent on effective knowledgeflows through training and continuous improvement programs and supply chain Collaboration, Information is not only critical for internal supply chain management operations,but can be a very effective regulatory tool w hich may cause organizations to reevaluatetheir supply chain processes. That is, environmental information flows may be usedto provide certain public images of the supply chain and its members.Having thisinformation made public can cause significant pressures from external stakeholders onthe overall supply chain to improve environmental and social performance . Recentresearch has shown that within the supply chain, information will have varying impactsand will be used in different ways by supply chain members. Overall, these differences inapplication and sharing of information and management of environmental informationflows is based on a variety of factors including expected costs or expectedrevenues/benefits related to environmental improvements, perception of externalstakeholder demand, perception of supplier relationship (from the perspective of thesupply chain manager) and top-management environmental commitment . Waste FlowsWe could consider waste flows as an element of all th e previous flows which doesnot necessarily have social (environmental) or economic benefit, non-value adding, to theunit under consideration. These waste flows cause greater costs to occur and may requireseparate programs to minimize them. For example, lean and green typically focus onminimizing waste and inefficiency within supply chains. Thus the management ofthis flow will also be critical, and may be separated within a supply chain. From abroader informational and industrial symbiosis perspective, waste exchanges betweenorganizations can alter the waste flows into useful material flows and have been appliedto disparate materials and flows such as water, construction material ,plastics,electronic products and energy .These waste exchange networksand flows not only can span inter and intra-organizational boundaries, but also acrossinformational boundaries as the waste exchanges become more available through Information and e-commerce systems. The other aspect of waste flows is tha t of end-of-lifemanagement or products andthe type of disposal that should be completed. There are issues with landfilling,incineration and returning materials back into the supply chain. Within the landfilling andincineration debate, the type of material may determine which is more economically andenvironmentally feasible. Rather than disposal of these wastes, recycling andreverse logistics network flows can be designed to manage these streams.Thus, as withany systems decisions, many variables will come into play before a clear-cut solution isavailable and decisions on managing these waste flows will range from individualconsumer level to broad governmental policies. The concepts pertaining to greening the supply chain or supply chain environmental management (SCEM) are usually understood by industry as screening suppliers for their environmental performance and then doing business with only those that meet the regulatory standards the driving forces for implementing the concept in to the company operations are many and comprise a range of â€Å"reactive regulatory reason to proactive strategic and competitive advantage reasons†.These concepts include working collaboratively with suppliers on green product design, holding awareness seminars, helping suppliers establish their own environmental program and soon. Thus there has to be a conscious need to integrate environmental concerns into the economic concerns of the strategy, in order to help contribute to the sustainability of the company’s future. Concern for the environmental performance of suppliers has now become the characteristic of responsible business practices. For instance, ford motor company has demanded that all of its suppliers with manufacturing facilities, comprising about 5000 companies worldwide, must obtain a third-party certification of environmental management system(EMS) for at least one of their plants by the end of 2001, and for all plants by 2003.o help the suppliers esta blish their own environmental management system, ford offers awareness seminars and training for its suppliers ,for them to be like any world class organization and attain their goal of environmental excellence . in the same manner, nestle Philippines also conducts seminars and provides technical assistance to its suppliers and contractors to help them implement and environmental management system that is consistent of Nestlà ©Ã¢â‚¬â„¢s environmental management system (NEMS). nestle hopes this initiative will help its suppliershave a fully functioning and effective EMS complies with regulations, judicious use of raw materials, the conservation of water and energy, and the minimization of the waste.This initiative of urging suppliers and contractors to meet certain standards of environmental performance is among the 16 principles of environmental management listed in the â€Å"business charter for sustainable development†, adopted by the international chamber of commerce in N ovember in 1990,it emphasizes the need for contractors and suppliers to ensure that their environmental practices are consistent with those of the enterprise and encourages wider adoption of these principles Supplier chain environmental management is being adopted by industry, though not in a very apparent way, in different parts of the world. The extent and mode of implementation vary significantly. In some instances the implementation takes the form of questionnaires identifying what suppliers are doing, often in terms of quality programmers such as ISO-9001.More and more of these questionnaires are now adays supplemented by specific environmental questions. In other instances the suppliers are assessed at their own sites either by personnel from the customer company or by a third party or consultant, supported by a examination of company records, documents and by interviews with company personals. gain, in certain other case the large companies are even going for partnering and m entoring with their suppliers: mentoring involving the development of a close relationship between them, say providing guidance to set-up an environmental management system(EMS) or a waste minimization program; partnering involving and integrated approach to their relationship to improve operational efficiency of each. Measuring the performance of supply chains: In supply chains with multiple vendors, manufacturers, distributors and retailers, whether regionally or globally dispersed, performance measurement is challenging because it is difficult to attribute performance results to one particular entity within the chain. There are difficulties in measuring performance within organizations and even more difficulties arise in inter-organizational environmental performance measurement.The reasons for lack of systems to measure performance across organizations are multidimensional, including non-standardized data, poor technological integration, geographical and cultural differences, di fferences in organizational policy, lack of agreed upon metrics, or poor understanding of the need for inter-organizational supply chain performance measurement. Performance measurement in supply chains is difficult for additional reasons, especially when looking at numerous tiers within a supply chain, and green supply chain management performance measurement, or GSCM/PM, is virtually non-existent. With these barriers and difficulties in mind, GSCM/PM is needed for a number of reasons (including regulatory, marketing and competitiveness reasons). Overcoming these barriers is not a trivial issue, but the long-term sustainability (environmental and otherwise) and competitiveness of organizations may rely on successful adoption.The basic purposes of GSCM/PM are: external reporting (economic rent), internal control (managing the business better) and internal analysis (understanding the business better and continuous improvement). These are the fundamental issues that drive the developm ent of frameworks for business performance measurement. It is important to consider both purpose, as well as the interrelationships of these various measurements of GSCM/PM. Corporate performance measurement and its application continue to grow and encompass both quantitative and qualitative measurements and approaches. The variety and level of performance measures depends greatly on the goal of the organization or the individual strategic business unit’s characteristics.For example, when measuring performance, companies must consider existing financial measures such as return on investment, profitability, market share and revenue growth at a more competitive and strategic level. Other measures such as customer service and inventory performance (supply, turnover) are more operationally focused, but may necessarily be linked to strategic level measures and issues. Conclusion: As supply chains are becoming increasingly globalized and multi-company based, the ecological footprin t principle deserves a broader application in the supply chain. Footprints are not only nation-based as suggested by Hart (1997); the scope of supply chains is far broader. This also implies that a focus on reversed logistics, as commonly used in the literature, is no longer adequate.Based on the existing literature, this paper presents a categorization of green approaches and suggests the value-seeking approach as the most relevant in greening the supply chain as a whole (instead of logistics, and regulatory compliance alone). In order to develop greening approaches as a competitive initiative, various elements have been suggested, including sets of actions for various players along the chain, as well as, measures of success. Much research still has to be done to support the evolution in business practice towards greening along the entire supply chain. Hopefully, this paper has identified some of the steps to take, while minding our footprint.

Tearing Down the Wall

Ever since I can remember, I’ve always had a knack for discovery as long as it was somehow related to video games or technology. If I didn’t know something, I needed to find out and if I didn’t, it would kill me. If I stopped working on something during the day, I would think about troubleshooting the issue during my sleep or for days on end. There were also times when I would stay up all night just to circumvent a virus on my computer or lose hours of sleep when I hacked a Nintendo Wii for the first time. There is no doubt about it, I love technology.I’ve always been told that I am thinker and a tinkerer, which is why nearly 10 years after graduating high school; I made the biggest decision of my life. In 2011, I decided to go college. Many have asked me, â€Å"Why don’t you back to school? † The truth is that I would’ve loved to go right after graduating from high school but life threw me a curve ball. During my senior year, my mothe r and step-father split up. My mother, a housewife who hadn’t work for nearly six years after meeting my step-father, made me assume she became accustomed to it.My mother was able to somehow support my sisters and I because of a settlement she won, but alas nothing lasts forever. I finally graduated high school expecting all of us to move into a Eduardo B. Morillo-Perez 2 new place while my mother and I both worked, but unfortunately it didn’t work out that way. We moved alright but my things went to a room and the rest of the contents of our three bedroom apartment went into storage. I was so confused and hadn’t a clue of what was going on. Soon enough, she mentioned something that I never would’ve expected. â€Å"Everything is packed and ready to go. We are all going back to Ecuador† she said.I refused, thus leaving me here with my belongings, having to fend for myself. I now lost the luxury of slacking off. I had to work any job available just s o I could pay the rent and not starve. I didn’t have mom or dad to ask for money. I had to put up with nasty customers at a fast food restaurant and being taken advantage by other co-workers because I didn’t know how to stand up for myself. I have tried to go back to school and went thought the proper protocols of filling out forms, writing essays, going on interviews but I could never get in without having to pay for everything out of pocket.The biggest hurdle was financial-aid. Due to the fact that I was of certain age, I was still considered a dependent and I had to provide my mother’s tax information. The only way I could have that waived was if I was married. It was then when I grew cold, bitter and blamed my mother for all my setbacks. I felt lost and alone. I felt like I had no one to turn to. As years flew by, I started noticing that I was using my mother’s negligence and lack of absence as a crutch, hindering my progress the entire time. I am not a religious person, I never was, but somehow I always thought certain things happen for a reason.In 2009, I got reacquainted with an old flame from high school. We soon began to catch up on things from the past and soon enough she put the moves on me and the Eduardo B. Morillo-Perez 3 rest is history. I can honestly say that she is the sole reason I decided to back to school despite what anyone told me. When Olivia first met me again for the first time, I was living by myself in a room while working a mundane retail job at the airport. Fast forward nearly four years later and you now have a second-year computer science major with a 3. 5 GPA who has his own car and is well on his way to work on the next gadget or program.

The difficulties and hard living which happened to them and their families after the war affected how they felt about slavery, and when white people and black people mixed together freely the black people were exposed to many more hateful whites than when they were segregated. Reading these interviews gives us an interesting perspective on what freed slaves felt and thought, both about their freedom and about their lives afterward. Everybody remembers their lives through the filters of time. These two men did not remember being mistreated by their masters, and so they have few bad memories of their former lives. From the 1600’s to the late 1700’s, America still has not changed in accordance to who is included in having rights; women always had the image of staying home and caring for housework and children, and slaves never had rights. A little after the personal corres pondence between Abigail and John, the Colonies finally gained their independence from Britain. Although the Declaration of lndependence, which was established July 4, 1776, did declare independence from Britain, this declaration also states laws to prevent something like the ruling of Britain happen again. In the declaration of independence it is stated that â€Å"We hold these Truths to be self-evident, that all Men are created equal, that they are endowed by their creator with certain unalienable Rights, that among these are life, liberty, and the pursuit of happiness† (Jefferson 1776) At the time, the words â€Å"All men are created equal† was not clarified unto who was created equal, did they mean all humans, or all males? The meaning behind â€Å"men† in that time period was meant for white men, or men who would vote, and had a voice and represintation. In this new ideal of America, many groups of people were excluded, such of those would again be women, and blacks. In 1783, however, Slaves do get their freedom if they served in the continental army. In 1801, when Thomas Jefferson gives out his first inaugural address In the Inaugural Address, he points to common underlying principles and a loyalty that transcends partisanship. In the Declaration of Sentiments Stanton rewrites the declaration of independence with one of the tweaks being â€Å"We hold these truths to be self-evident; that all mem and women are created equal†(Stanton 1848) This reminds us of how American’s have gotten carried away from including everyone, now to just certain groups. These characters set the stage for a lasting relationship to form, to be strengthened, and to be stressed. Danny’s father’s name is Reb Saunders. The tzaddik of a small community within close proximity of Reuven’s home, he was born in Russia and later brought his congregation to America. When Danny is speaking to Reuven, he tells him the story of this occurrence. â€Å"They bribed their way though Russia, Austria, France, Belgium, and England. Five months later, they arrived in New York City.† This was the original catalyst for the relationship between Reuven and Danny. If Reb hadn’t brought his congregation to America, ever, Danny and Reuven would not have met in anything close to the same circumstances. When introducing the reader to the novel, Reuven explains why the inter-parish softball leagues were formed by the Jewish parochial schools after World War II. â€Å"†¦America’s entry into the Second World War and the desire this bred on the part of some English teachers in the Jewish parochial schools to show the gentile world that yeshiva students were as physically fit, despite there long hours of study, as any other American student. They went about probing this by organizing the Jewish parochial schools in and around our area into competitive leagues, and once every two weeks the schools would compete against one another in a variety of sports.† This was the second factor in the friendship. It would be unlikely for the matter of a soft-ball league to be considered on the part of Reb Saunders if he had not seen any particular reason. On Danny’s second visit to the hospital, Danny and Reuven talk about matters of common interest. While on the topic of the baseball game, Reuven asks how he learned to hit a ball. â€Å"‘I practiced,’ he said. ‘You don’t know how many hours I spent learning how to field and hit a baseball.’† After this statement is avowed, Danny makes the comment to Reuven that he could have ducked the ball. Reuven responds with: â€Å"I remembered the fraction of a second when I had brought my glove up in front of my... ...arefully of what you will say. Think what your father’s questions will be. Think what he will be most concerned about†¦Ã¢â‚¬â„¢Ã¢â‚¬  When David persistently asks Danny questions as Danny half-answers, anxiety is created as the significance of the questions is revealed. All of these factors put stress on the relationship, initially, and in the end strengthened it. The first mentioned, was the difference between Danny and Reuven’s religions. Although they were both Jewish, the novel shows that there were perceptible differences. The next mentioned was Reuven’s inability to understand â€Å"listening to silence†. Although Reuven may not have seen significance, Danny found silence to be very important, even related to wisdom. The final stressor mentioned was David’s methodological questioning of Danny at the end of the novel. It created tension in an already stressful situation, although helpful. Danny and Reuven’s friendship built throughout The Chosen had the roots to last a lifetime. It was apparent that Danny originally needed a friend and Reuven turned out to be the right one. Also, their fathers recognized this lasting friendship. So, each would most likely encourage it in the future.

The second prong of the Anns test thus prevents the government from becoming an insurer of all potential harm which the government is found to have a proximate relationship to. The test set forth in Anns is important to understand when discussing Cooper v. Hobart, which was adopted as the test for the duty of care for the government and its agencies after Kamloops v. Nielson. This is because Cooper v. Hobart is the case which is said to have redefined Anns into the current standard, the Cooper-Anns test. Facts of Cooper v. Hobart Cooper v. Hobart is a case involving the Registrar of Mortgage Brokers, a statutory regulator of mortgage licenses. In the case, Eron Mortgage Corporation was a mortgage broker as defined by the Mortgage Broker’s Act. â€Å"Eron acted as a mortgage broker for large syndicated loans. It arranged for numerous lenders (or investors) to pool their funds for the purpose of making a single loan to a borrower, which was typically a developer of commercial real estate. The syndicated loans were made in the name of Eron or one of its related companies, which held the security in a trust for the investors. Cooper, an investor, had advanced money to Eron. Hobart, in his official capacity as Mortgage Broker Registrar, suspended Eron’s mortgage broker’s license in October of 1997 because Eron was allegedly using the funds of their investors for unauthorized purposes. Shortly after the suspension of its license, Eron we... ...tending the current duty of care to a new duty of care, there were policy reason to find that there was not a proximate enough relationship between Cooper and the Registrar to establish a duty of care. Furthermore, the Registrar owes a duty to act in the interest of the public at large which may at time have competing interests with investors.

Chick Lit Genre Analysis

A protagonist in a chick lit book is typically a self-critical female with unreasonably high expectations. In â€Å"24-Karat Kids†, a novel by Dr. Judy Goldstein and Sebastian Stuart, Shelley is hired as a pediatrician at a ritzy Upper East Side office. She quickly realizes that she doesn’t look like the other women that work, or visit the office everyday. She’s very critical of her own appearance, â€Å"Staring back at me was a plain, tubby young woman with an absurdly garish scarf around her neck† (Goldstein 12). Shelly isn’t built like the other females and wasn’t raised wealthy. She is unreasonable to expect herself to look exactly like the others and fit in instantly. She critiques her body in every mirror she passes and quickly adopts a strict diet: â€Å"I’d been on the only diet that worked for me: starvation† (Goldstein 30). In order to fit her unreasonably high expectation of achieving the â€Å"perfect† body, she goes to extreme lengths. Shelley has been in a serious relationship for over two years with a man named Arthur. He has a secure job, is kind and compassionate and has recently proposed. The two begin apartment hunting and stumble upon a nice unit in Brooklyn. Shelly used to love Brooklyn before she started her new job. When Arthur pressures her to share her opinion on the apartment she wonders, â€Å"Why did my mind keep racing back to the Upper East Side, to Dr. Marge and Amanda Walker and Christina Allen, to a world filled with wealth, excitement and glamour† (Goldstein 53). Her current lifestyle just isn’t good enough for her anymore. She wants the luxury her clients and coworkers experience. Although she has a fiance many dream of having and the chance to move in to a comfortable apartment, she can’t settle for anything less than the best. Chick lit books are typically written in first person to allow the protagonist to analyze and share her opinions on all matters. Shelley and her fiance Arthur go apartment hunting a week after Arthur’s proposal. They have never lived together before and Shelley is hesitant to oblige. Arthur is pressuring her to sign a lease and she thinks, â€Å"In many ways I was just beginning my life and the idea of giving up my independence seemed, I don’t know, rushed. Couldn’t it wait until we were married† (Goldstein 30). Since the book is written in first person, Shelley is able to let the reader in on exactly what is going through her head. She doesn’t really want to move in, but can’t tell Arthur that. If she wasn’t able to share her though process with the reader then people would think Shelley was actually okay with this relationship milestone. Later in the week Shelley meets her new boss. She has an image in her head of what she expects the woman will look like but over analyzes her when they meet for the first time anyways: â€Å"she looked as if she should have been out shopping on Madison Avenue. Somewhere in her fifties, she had frosted blonde hair and expert, subtle makeup, and was wearing high heels and a belted magenta jumpsuit that accentuate her tiny waist. Definitely the most glamorous doctor I had ever seen† (Goldstein 14). Shelley describes what people are wearing in excessive detail all the time. She often make a judgment about their personality based on their outward appearance and always shares these with the reader. Her thorough analysis of the other characters allows readers to gain a better understanding of how everyone in the novel interacts.

Diversion in the Criminal Justice System Essay

Diversion has been known to be called, â€Å"the easy way out†, or â€Å"a slap on the wrist†, but diversion entails more than an offender saying, â€Å"They got an easy way out†. According to the book diversion can be a type of rehabilitation, â€Å"The National Academy of Sciences defines it as â€Å"any planned intervention that reduces an offender’s criminal activity† (Walker 2008, pg 251). Most criminal activity is done by people from the ages of 14 and 24. The main goal of rehabilitation programs is to reduce crime sooner than later the book refers to it as, â€Å"planned intervention program, that might include counseling, education, job training, or some other program† (Walker 2008, pg 251). Diversion is meant to help keep people out of the criminal justice system; due to the fact most of them are not violent offenders. It refers to people that are not a serious threat to society, but made a wrong choice and it is their first time of fending. Using diversion, the courts hope that it will not only keep people out of the criminal justice system, but it will help them, rehabilitate them, or try to resolve the problem. It also is an additional way to keep from overcrowding jails, courts, and any kind of correction institution. In doing this the courts can focus on more serious offenders. According to the text book, â€Å"diversion is a planned intervention with a treatment component and the goal of getting offenders out of the criminal justice system as early as possible† (Walker, 2008,pg.262). In diversion the offender is given a jail sentence as in â€Å"11/29† if the offender does not commit any more crimes then they will be expunged from the criminal justice system and then they will have a clean record. However, if they recommit a crime, they will have to serve 30% of their original given jail time. For example- 30% of â€Å"11/29† in jail, would  be 109 days. When given diversion, the offender is usually given probation as well. With probation the offender usually has a class that he/she has to attend that is part of their rehabilitation process. According to the peer reviewed journal, â€Å"Probation and Diversion: Is There a Place at the Table and What Should We Serve states that, â€Å"Three times as many offenders participate in probation and/or diversion programs than incarcerated. Probation and diversion programs are considered â€Å"alternative† punishments, and public policy has not focused on how to strengthen community corrections. New developments on targeting specific behaviors through the use of theoretical models of supervision can improve outcomes, or at least delay further offending?† (Taxman, 2010). Probation is a way to stay in touch with the offender, by having them come in and have meetings with their probation officer. The reasoning for this is to keep the officer up to date with the offender and the offender’s progress. They make sure that the offender is doing everything they are suppose to do, paying court cost, trying to find a job, not getting in any more trouble, and to just make sure the offender stays on top of their priorities. The classes and programs are meant to help the offender in many ways such as; realizing that they made a mistake and to see how they could possibly better themselves, or whether it’s hanging out with a different crowd, or just saying â€Å"NO Thanks†. Diversion has been around for centuries. According to the text book, â€Å"Diversion was one of the great reforms of the 1960s† (Walker, 2008, pg.262). This statement backs up some of the history behind diversion. A article concludes more information about the history of diversion, â€Å"The concept of diversion of juveniles from the juvenile justice system has a long history in the scholarly literature as well as in federal juvenile justice policy. The theoretical background of diversion is based on the â€Å"labeling† principles dating back to Tannebaum (1938). The scholarly debate was further developed by the research of Becker (1963) as well as Lemert (1951). Becker (1963) argued that labeling by certain social groups in power have a detrimental effect on juveniles. The work of Lemert (1951) discussed the effect of secondary deviance of juveniles that were processed through the juvenile justice system and contributed to the argument that the system, instead of help ing, may actually contribute to further delinquent acts of  juveniles† (Marsh, 2005). This makes complete sense why this would be thought of in the way it was. Tannebaum, Becker, and Lemert were all right in the idea that juveniles should be dismissed from the criminal justice system, to be given another chance. They also said that if juveniles were not dismissed from the criminal justice system that â€Å"labeling† could take affect very easily. If a juvenile is proven guilty an certain crime, that could essentially lead the individual to living up to their â€Å"label† and lead them to commit more deviant acts. This is why they try to give them another chance and treat them with a diversion program of some sort. An additional quote from text book states that, â€Å"Commission gave it strong endorsement in 1967, and in the 1970’s an estimated 1,200 diversion programs were established† (Walker,2008,pg.262). Given this information one could conclude that during the 1960’s the criminal justice system was establishing more of a variety of ways to help people and trust them with a second chance. The text book does explain that this was not the â€Å"first† form of diversion, â€Å"Historically, many offenders were diverted from the criminal justice system at an early age. Police officers routinely chose not to arrest someone even though there was probable cause, and prosecutors dismissed the cases when prosecution would not serve the â€Å"interest of justice†. We call this old diversion† (Walker, 2008,pg. 262). Police officers have been practicing diversion for a long time. They trusted that the offender would not recommit once they had been caught once, considering it was their first time, or they only committed a minor crime. However, the diversion that is used today is more of a modern approach. Programs are offered, that instills goals in people, and is managed by a professional staff that offers assistance and treatment. According to Taxman, â€Å"These models are important since they help provide a meaning to the core practice of diversion/supervision programs—face-to-face contacts. Moving away from generic contacts to ones that are focused on specific behavior holds promise in elevating the value and importance of probation and diversion programs in correctional policy and practice†(Taxman,2010). This is how program and treatment are today. The professional workers are more involved and tuned in to their clients’ problems. All of this is to try to keep people out of the criminal justice  system. The more people that are kept out of the system, the better off the system will be. Diversion puts that fear into someone, because they know if they mess up again then they have to serve 30% of their jail time. Diversion is meant to act not only as a â€Å"second chance†, but also a deterrent to not commit future crimes. Has diversion been proven to help people? Everyone is different and diversion helps some people and for others it does not work. For the people it does not work out for, are usually trying to ride out the system, getting in trouble, getting longer probation sentences, according to a academic journal, â€Å"Developing restorative practice: contemporary lessons from an English juvenile diversion project of the 1980s.† states that, â€Å". As a result, the projects quickly became skilled in negotiating solutions in the interests of, and according to the wishes of those affected, while also enabling young people to acknowledge their own responsibilities and to take action accordingly. These successes have not been built upon effectively† (Smith,425-438,2011). In this sense diversion has not been successful; the people that were involved in this research had not taken diversion seriously and had been irresponsible for the actions they had taken. On the other hand, some peopl e do take it seriously and it has been proven successful. Diversion can be tough, according to an article concerning diversion programs, â€Å"Maryland’s diversion program for alcohol-impaired drivers (i.e., PBJ) allows a driver to plead guilty or nolo contendere, or to be found guilty in a criminal proceeding but have judgment stayed pending completion of a probationary period. Conditions of probation may include participation in treatment, an alcohol education program, selfhelp groups (e.g., Alcoholics Anonymous), and/or the ignition interlock license restriction program. Drivers who violate the terms of probation (including having another alcohol-related offense) may have the original charge reinstated and be further prosecuted for violating probation† (Ahlin). This is an example of a diversion program, it explained the proceeding s and the conditions that went along with the program and what would happen if the  offender failed to participate successfully. It also explained that in doing the following treatments that go along with the program are considered â€Å"self help† groups, like Alcoholics Anonymous and this can be a way to help someone while they are under probation and eventually help them be expunged out of the criminal justice system in the near future. Diversion programs are initially a way to help individuals make better choices in the future, and to have hope in the offender that he/she learned their lesson the first time. Another time of diversion program is called Adolescent Diversion Program (ADP). This program is based on juveniles. This particular program is to help juveniles be more involved and it emphasizes on community service work. The article states, â€Å"a community centered paradigm where students are taught to work with communities to better understand contexts surrounding a social problem, as opposed to merely volunteering to provide a service to a community. The Adolescent Diversion Project (ADP), which has been operating for over 30 years, demonstrates critical community service through the type of relationship built between students and the local community† (American Journal of Community Psychology, 2010). This program focuses on young adults and to try to steer them away from crime by having them do community service work and be more involved. An article inquires that, â€Å"Diverting juvenile offenders from the traditional juvenile justice system has been influenced by various theories but most prominently, labeling theory and differential association theory. Differential association theory’s basic premise is that through association with deviant groups, individuals are more likely to become deviant themselves. Juveniles incarcerated with other juvenile offenders will interact and are more likely to join deviant groups† (Marsh 2005). This is a good reason why the ADP program deals and focuses on juveniles. If more attention is paid to young adults and they are stopped right when they get in trouble it could be a factor in reducing crime, because if they are stopped and corrected while they are young, they will not commit when they get older, or possibly age out of it. People debate whether diversion and diversion programs work, in the sense of reducing further crime and deterring people from recommitting according to an article, â€Å"Scholars have examined which types of sanctions are more likely to reduce recidivism and have found that punitive approaches such as conviction or jail do not significantly deter future incidents of DWI  (Taxman & Piquero, 1998; Wheeler & Hissong, 1988; Yu, 2000)† (Alhin). In this quote it explains that jail time, or convictions do not always work as a â€Å"deterrent† for the offender when he/she gets out of jail. Due to this, they will have to use other significant deterrent applications, or at least try them. They could use probation as a deterrent instead of putting everyone in jail. Putting everyone in jail causes a big overcrowding issue and some people they put in jail are not huge criminals, they may have just committed a minor crime. However, by putting them in jail they could â€Å"learn† how to be a criminal and when they get out, they could potentially commit crime. The article extends to explain how the deterrence theory could work in this situation, â€Å"Consistent with deterrence theory (Beccaria, 1764/1963), swift license sanctions such as suspension and revocation have been shown to reduce DWI recidivism (Ross, 1991; Yu, 1994; but see Yu, 2000), and less punitive, treatment-based sanctions can also reduce recidivism among drivers with an alcohol disorder (Taxman & Piquero, 1998)† (Alhin). This quote states that by using the deterrence theory, revocation has been proven to reduce DWI recidivism. It also says by using more â€Å"treatment† based corrections could help the offenders not recommit drinking and driving. If the offenders can receive help with drinking intensively, or get help with drinking and driving, this could keep people out of jail and also save lives by not having peo ple out on the road drinking and driving. Diversion has been around for a very long time, and over the years there have been many studies, researches, and experiments done to try and understand what the most effective way to make diversion programs work. There have been several people that have conducted studies to see what they could encounter on the subject of diversion. One group an author states was, â€Å"Kammer and Minor (1997) evaluated a program that intervened in cases of juveniles ages 11 to 18 years charged with status or low-level delinquent offenses and no prior record. The program was 16 months long and only handled 12 offenders at a time. Of the 86.2% (N = 81) who graduated, 67% were rearrested during the evaluation follow-up. Of the juveniles originally arrested for status offenses, those that recidivated were charged with delinquent acts† (Marsh 2005). This statistics are just from one study, but over half of the offenders were rearrested, so this complies that their study on diversion programs were not successful enduring that when juvenile offenders receive diversion, in their study over half were arrested again. However, an academic article states â€Å"Although much research has been conducted to test diversion methods, few have taken advantage of true field experimental conditions (Campbell, 1969; Severy & Whitaker, 1982). Unfortunately, utilizing true experimental designs in the juvenile justice setting can have serious political implications† (Severy & Whitaker, 1982). Yet the absence of a control group design prevents testing from a baseline. The methodology of the current project allowed the comparison of the groups to each other and the comparison of the different treatment interventions to a baseline control group† (Marsh 2005). In the quote it explains that when research is not done in the field, using expe riments with offenders could lead to trouble when it comes to trying to understand diversion and its effectiveness. This is an important part of research, because one is learning through the actual offenders and studying their ways of doing things. In addition the author states, â€Å"One of the most significant issues raised by diversion was the â€Å"net-widening† effect of this type of program. In an evaluation of 11 California diversion projects, Bohnstedt (1978) found that one half of the 3,871 clients served would not have been processed by the system if court diversion programs were available† (Marsh 2005). Another study conducted encountered juveniles and the use of tobacco. The juveniles that were caught using tobacco were given options of different punishments, â€Å"Juveniles cited for use of tobacco were given the option of going to court, paying a fine, or attending a single 2 ½-hour diversion course that discussed the harms of tobacco use† (Marsh 2005). Most of the juveniles chose to pay the fine instead of attending the class. The article intended that this study the juveniles that attended the class and the juveniles that paid the money had no change in behavior, or attitude. However, the juveniles that paid the fine, they were proven to have lower tobacco usage. With having this knowledge, one now would know that using the right kind of treatmen t is very help when doing research in diversion based programs, because if something is off, or missing it could through the whole experiment off. Another issue that was brought up is having diversion everywhere in the United States, because the overcrowding  in jails is one of the biggest, money rackets U.S. citizens and the government deal with. If diversion programs were offered everywhere then it could possibly cut down on the incarceration rates in the United States, â€Å"Treating youth in the community diversion is seen as a way to reduce further involvement with the juvenile justice system. The idea has been particularly intriguing because of its added benefit of relieving an overburdened judicial system† (Whitaker, Severy, & Morton, 1984, pp. 175-176) (Marsh 2005). If diversion was used more often and courts were able to keep more people out of jail by using diversion programs, it would cut down on the tax payers that pay for people to stay in jail and possibly help the people get rehabilitated. Diversion is a good idea for first time offenders and helps them steer clear of trouble, if they actually follow the rules and do not recommit any offenses. Diversion programs have been proven to help people, but it has also been proven to not show any difference in the offender’s actions. I believe that aging out of crime has a lot to do with juvenile offenders and even adult offenders. Big Q

This is shown in the book Lice's Adventures in Wonderland by Lewis Carroll when Alice chases the rabbit down onto a rabbit-hole without giving it any thought Alice Just Jumps right in not thinking about the consequences â€Å"In another moment down went Alice after it, never once considering how in the world she was to get out† (Carroll 20). Another example of instinct overcoming rational thought is found in Milan, a Disney movie about a girl who goes and fights for her injured father in a war that he would most likely not have survived in.In a specific scene she sees her father and grandmother arguing through the window and from that point is determined to do anything to keep her father from owing back into action (Walt Disney Pictures 1998). Milan does it because she loves her father and wants to make her family proud by saving him from having to fight again. Her instincts make her very emotional and lead to her becoming a warrior and bringing Joy to her family. Most people act first and think later causing emotion to overpower their logic. Secondly, emotion prevails over reason because it is more heart-felt and sentimental.The book A Tale of Two Cities by Charles Dickens contains various quotes that help to connect to emotion. The first quote that relates to the big question is about a man who Just lost his daughter due to the recklessness of the Marquis: â€Å"A tall man in a nightcap had caught up a bundle from among the feet of the horses, and had laid it on the basement of the fountain, and was down in the mud and wet, howling over it like a wild animal. Pardon, Monsieur the Marquis! Said a ragged and submissive man, it is a child. Why does he make that abominable noise? Is it his child? Excuse me, Monsieur the Marquis-it is a pity- yes. â€Å"It is extraordinary to me, said he, that you people cannot take care of yourselves and your hillier. One or the other of you is forever in the way. How do I know what injury you have done my horses? See! G ive him that. He threw out a gold coin for the valet to pick up, and all the heads craned forward that all the eyes might look down at it as it fell. The tall man called out again with a most unearthly cry, DEAD! † (Dickens 115) This quote tells about a man who Just lost his daughter in the blink of an eye and can't control himself, so he Just starts sobbing uncontrollably and crying out like a wild animal.His heart is broken and he has no time to think. All he feels is sorrow and it affects everyone around him. The people around really feel sympathy for this guy and react emotionally as well. They are angry at the Marquis, and they are angry at how they have to live their lives because of the imposing government as well. All of these emotions (angry, somber, and scared) mixed together, also help lead to revolutionary thinking, which is a big part of the book.Another quote that connects the novel to the big question is about the killing of the Marquis: â€Å"It lay back on th e pillow of Monsieur the Marquis. It was like a fine mask, suddenly startled, made angry, and petrified. Driven home into the heart of the stone figure attached to it was a knife. Round its hilt was a frill of paper, on which was scrawled: Drive him fast to his tomb. This, from Jacques. † (Dickens 252) This quote is about the killing of the Monsieur the Marquis and it helps to reinforce the argument. Sentiment is shown in the quote by how personalized the killing was made out to be.The Marquis was stabbed straight in the heart and there was a letter signed by the killer â€Å"Jacques†, an anonymous name used by many evolutionarily used to keep the identities secret, but also used to show that they all had one goal or one purpose in mind. It emotionally bonded all the revolutionaries together showing unity. Another source that connects to emotion is a British television show called Sherlock. As the title gives away, the show retells the story of Sherlock Holmes in modern times. Sherlock is the most rational, logical, and mostly sane person of all time, but even he succumbs to his emotions at times.He falls in love with a spy/ enemy informant and she gets sent to a terrible place where she will most likely die, but even Sherlock with all of his wisdom cannot stop himself from saving her. He knows it is the wrong thing to do because she lied to him and conned him out of important information, but he cannot help what he feels in his heart. (Gait's 2010) Lastly, emotion is stronger than reason because it is irrational and spontaneous. The book Lice's Adventures in Wonderland by Lewis Carroll showcases many absurd things and emotions.A doctoral candidate at the University of Texas explains the homes and background of the book and is in agreement, â€Å"the absurdity, even insanity, of the world from the point of view of the innocent. Alice enters the rabbit hole and from that point on is confronted with crazy experiences that leave her very emotional.Although emotion overpowers logic in most situations, reason may be evident at retain points in time. An example of this would be an argument of an atheist against religion. The atheist believes in facts and what he/she can observe in the universe around him. Atheists do not believe in having a blind faith towards anything that is not measurable in any humanly way, while religious people are perfectly content with believing that there is some sort of god. A census taken in England in 2011 showed that the numbers of atheists were increasing while the numbers of Christians were decreasing.
